Rewards Program Terms
1. Introduction
1.1 We strive to exceed your expectations and want to reward your loyalty to us by creating a loyalty program for your benefit where you can earn points to spend with us.
1.2 These Rewards Program Terms of Trade (“Rewards Terms of Use” or the “Program Terms of Use”) are to be read in conjunction with the ECOM USA Terms of Use (“ECOM Terms of Use”) above. All ECOM Terms of Use apply to these Program Terms of Use. In the event of a conflict between the Program Terms of Use and the ECOM Terms of Use, the ECOM Terms of Use shall prevail.
1.3 By participating in the Silver Fern Farms Rewards Program (“Rewards” or the “Program”), Members (“Members”) agree that you have read, understood and agreed to these Program Terms of Use and all applicable rules, policies and procedures of the Program, including, Silver Fern Farms’ ECOM Terms of Use and Privacy Policy. Each Member is responsible for remaining knowledgeable about the Program and these Program Terms of Use. We reserve the right to alter, limit, modify or terminate the Program, the Program structure, any other feature of the Program, or these Program Terms of Use without any advance notice. Your continued participation in the Program will confirm your acceptance of such changes. We reserve the right at our sole discretion to disqualify Members who have violated any of the Program Terms of Use.
2. Membership
You will be automatically signed up to the Program when you create an account (“Account”) with us, at our US e-commerce website, also referred to as the ”Website) however, you can opt out at any time from the Program at anytime by clicking here or emailing supportusa@silverfernfarms.com. In order to have an Account with us on the Website, you must be a registered user of the Website and have a username and password. There is no requirement to make any payment, or purchase, or to provide any credit card information to sign up for the Program.
You must be age 18 years or older to be eligible for membership. Membership in the Program is limited to one Account per individual. Membership is not available to corporations, businesses, charities, partnerships, enterprises or anyone other than an individual, unless with prior written approval from us, in our sole discretion.
Each Account remains the property of Silver Fern Farms and must be surrendered upon request. Program rewards have no cash value, cannot be sold, bartered and are non-transferable whatsoever. The sale, barter, transfer or assignment of any reward or benefit offered through the Program, other than by us, is expressly prohibited and will be cause for termination of your participation in the Program. Only the Program Member that is paying for the transaction of any products on the Website not including gift cards (“Qualifying Purchase”) may accumulate rewards and benefits and only the Program Member may redeem rewards that have accumulated in that Member's Account. Any rewards or benefits offered by us under the Program are subject to change at any time in our sole discretion, without prior notice. The Program is void where prohibited by law.
We will communicate with Members about marketing via email, SMS and other channels, including about special Member promotions, offers, and more. You may have the right to opt out of these communications in accordance with our Privacy Policy.

Once you are a registered user of the Website, you may view a summary of your Account on the Website.
You may cancel your membership in the Program at any time. Upon cancellation of your Membership, any unused points accrued in your Account will be forfeited and cannot be redeemed whatsoever.
3. Earning Membership Points
Members can earn rewards points (Point or Points) on the purchase of any of our Qualifying Purchase offered on our Website, unless otherwise stated. For all online purchases, you must be a registered user of the Website and have linked your Account number with your online account to utilise your reward Points for online purchases.
Members earns points when you buy a Qualifying Purchase on us.silverfernfarms.com if the Member is logged into the Website. Points are rounded down. You can find out more about the rate that which points are earned here.
During promotional periods, the number of Points earned per dollar spent may increase during promotional periods which will be clearly defined campaigns with start and end dates specified. In the event of no end date being specified, we reserve the right to end the promotional period increased Point earning at our sole discretion. Bonus points may differ in usability from that of ordinary Points.
Calculation of Points excludes payment by the Member for shipping charges and all taxes, including without limitation, federal, state, local or use taxes. All purchases made without a Member being logged onto the Website with the Member's account are not eligible for award of Points.
4. Redeeming Points
Points earned by a Member may be redeemed using a minimum of 100 points
Members can use their Points to reduce the purchase price of a Qualifying Purchase based on the following scale found here, noting all dollars are in USD.
To redeem points towards a purchase, a Member must have a current Account with us. The amount of Points required to redeem any Qualifying Purchase may be substantially increased or decreased, any award may be withdrawn, and restrictions on any award or its redemption may be imposed at any time by us. We may prohibit award redemption for any Member at our sole discretion or when required by law or otherwise.
Members release Silver Fern Farms and its respective subsidiaries, divisions, and affiliate entities, (together “Entities”) along with each such Entity’s respective officers, directors, employees, and agents from and against any and all liability relating to your Membership or participation in the Program or these Program Terms of Use. To the fullest extent permissible under applicable law, we are not responsible or liable for any direct, indirect, incidental, consequential or any other damages under any contract, negligence, strict liability or other theory arising out of or relating in any way, directly or indirectly, to Members' participation in the Program. This applies even if foreseeable or even if Company has been advised of the possibility of such damages.
Points accumulated on different Accounts of different Members may not be combined or aggregated to make purchases of a Qualifying Purchase. Points earned in a transaction cannot be redeemed in the same transaction. Discounts cannot be stacked.
All Points expire on the 12th (12) month anniversary of the date the Points were earned by the Member.
Member is responsible and liable for any shipping costs or applicable federal, state or local income, sales, use or other taxes which may result from Member’s participation or purchases when redeeming their Points.
Points earned for a purchase that is then the subject of a return, refund, or other credit will be deducted from the Member’s Account in an amount equal to the points earned for the original transaction, including bonus Points.

5. Miscellaneous
Silver Fern Farms and each of its respective Entities, along with each such Entities’ respective officers, directors, employees, and agents make no warranty, express or implied, including but not limited to, any warranties of merchantability or fitness for a particular purpose with respect to the Program or any products or services related to such Program.
Any illegality, unenforceability or invalidity of a provision of these Program Terms of Use does not affect the legality, enforceability or validity of the remaining provisions of these Program Terms of Use.
You agree that the resolution of any dispute, claim or controversy related to this Program shall be conducted on an individual, not a class-wide basis, and that no such proceeding may be consolidated with any other legal proceedings involving us. You further agree that you, and anyone asserting a claim for you, will not be a class representative, class member, or otherwise participate in a class, representative, consolidated or private Attorney General proceeding against us.
